  • Sister pinching Mothers money??

    Hi All.
    My sister and I both have LPA for my Mother who is 95 and has dementia. I’m worried my sister is pinching her money!!

      As your mother's attorney, can you get access to her recent bank statements and check what withdrawals/payments have been made?

      If you honestly believe that she is misappropriating your mother's money you will need to address it with your sister and/or seek advice from an appropriately qualified legal professional. I believe it is possible to remove someone as attorney if necessary.

      Maybe going forward speak with your sister and arrange a simple accounting system (e.g.Excel spreadsheet) to keep track of spending. This can help in other ways because it can be used to demonstrate any "gifts" made for inheritance tax purposes

        If you believe someone is abusing their power of attorney your correct procedure is to report your concerns to the Office of Public Guardian
