  • Scaffolding issues

    Hello all.
    My neighbour and I both own our properties and have lived here for many years.
    My neighbour had scaffolding erected over 1 year ago to do some work on a chimney or roof and it is still in place!! The issue is that some of the poles are on my land and at first, I didn't mind as I was told that it would soon be removed which obviously hasn't happened. When I try to speak to my neighbour he is abusive and threatening. I am an older lady who has lived here for many many years alone and get on well with all of my other neighbours.
    Can anyone please advise me of my rights and how I can enforce them?

    An annoying nuisance and being taken advantage of.

    As you are not on speaking terms, and as the permission to place the scaffolding on your land was verbal and only expected for a short time, I would write (keep copy & get free certificate of posting from Post Office) telling your neighbour that permission for placing scaffolding is withdrawn.
    Tell him that the scaffolding must be removed by dd/mm (give about 7 days notice), and that if he fails you will be applying for a court order for its removal and that your application will include an adverse costs order.

    Send a copy of your letter also to the builder and scaffolding firms if you know who they are
