  • Distribution of Estate

    Hi there,
hopefully relatively simple one. I am sole executor of my parents estate to be an equal split between myself and my sister. To put it bluntly she is not a pleasant person and has left EVERYTHING to me as she simply couldn’t be bothered. Do I need to get a solicitor to make the final payment of her part. The reason I ask is I simply do not trust her to hive her own correct bank details to me as she is on benefits and this is way over threshold of savings and she will lose all benefits. I have asked her to get a solicitor but she refuses. What is best course of action to avoid any redress to myself.

As sole executor everything is your responsibility, and if she is as you state, you were probably better off having to see to everything yourself!

Just ensure you keep meticulously correct inventory and accounts.
No need to use a solicitor, just send (signed for) your sister a crossed cheque made payable to her.

I’ve been meticulous in keeping EVERYTHING, even got spreadsheets accounting for every penny spent by date. She’s that deluded she’s demanding the money even though sale isn’t completed yet! This is nothing new from her, it’s just made her worse!! I just want everything to be above board with no redress to me

did you consider an executor's liability insurance just in case you made a mistake?

No, because I haven’t made any mistakes and it is a relatively simple estate with a will. But thanks for pointing that one out! Not like I’m under huge stress right now!
