    Hello there
    i received a letter from the county court business center which i have acknowledged but would like some help or advice on how i defend myself against vcs who have handed me over to the courts for not paying a parking charge notice. They claim that i was parked on private property i had gone to a shop that is based on a business park and that i am a member. To get to any of the businesses there you drive on a road to enter all the businesses. there are signs that say no parking private land which are all around the businesses and their car parks which i assumed the signs where for them it does not say anything about parking on the road there are some double yellow lines on some of the roads where i parked was not on a double yellow line and there were a few other cars parked there as well so i thought it would be ok to park there as i was only going to be 15mins the most i have my receipt from the shop as proof i was in the shop as it has the time and date on it the notice which they left on my car windscreen wasent a parking charge notice just a privacy notice which i didn't discover until i went to another retail park and had no idea as to where it come from till the letter came through the post i left the shop at 11,55 and the time they left the notice was 11,45 would appreciate any help the fine went up to £160 plus £25 court charges

    So what did the Notice to Driver claim was the alleged breach? Have you checked if the road was adopted? When, after breach, did the Notice to Keeper arrive

    I would suggest you edit so that the identity of the driver cannot be inferred

      The alleged breach is as follows:

      The claim is for a breach of contract for breaching the terms and conditions set on private land.

      im not sure of the road has been adopted or how to check this, are you able to assist? The road is Epsom Road, Epsom Square & Aintree Avenue, Trowbridge BA14 0XG the date of the alleged offence was 17.12.2019 and the first notice received was issued 20.01.2020. On this letter they claim to have sent a letter on 20.12.2019 of which i have never received.

      the have provided two photos of the car parked stationary both of these dont show the driver and show the private land sign visable on the other side of the road.

      also worth noting the "privacy notice" reference Excel Parking including their website address and the parking charge Notice "PCN" is from a company called Vehicle control services Ltd adding further confusion.

        So go and get photos of the signs !

        post up a redacted copy of the letter you received.

        Send a SAR to VCS for all documents they have concerning you. They have, unfortunately, 30 days to repond

        contact the local authority and ask them if the road is adopted. The information may be available on a web page.

        If the signs say Excel then VCS can't bring a court case. It's happened before.
