  • Am I liable to pay the X’s insurer ?

    Hello,

    Back in December, I got into a small accident in a road. I was on a cycle and as I was changing the lane, the car in front hit their brakes because of the traffic light ahead. The force of the brakes hit the car in front of me and I basically got thrown of my bike. As a result the car had a smashed window and a bump. I was checked by the ambulance crew and told me I go into the hospital to check myself out however at the time I felt fine with a few bruises. After a couple of days, the lady texted me with a fee amount of £400 which I am paying her directly into her account. The fee was for the maintenance fee to repair her car at the garage. However, a couple of months forward to now, her insurance sends me letter saying I have additional fees to pay. I am in shock because she did not tell me beforehand.

    Therefore, I am seeking for some advice.

    please leave comments on how I can resolve this because I fee betrayed.

    Your post is a little unclear.
    Did you cause the accident?
    You appear to have admitted liability by agreeing to pay for repairs to a third party.
    Do you think the third party contributed to the accident?
    If so how?

    Do you have your own public liability policy, either a specialist cyclist's policy or as as part of your household insurance?
    Are you a member of a cycling club?

    Was the incident reported to the police?

    Did you go to hospital to have your possible injuries checked?
    Have you had any delayed outcomes requiring treatment?

    Was your bike damaged?

    By agreeing to pay a sum already it may be seen as settling the case, but that is debatable
    At what point did you agree to pay...... was it at the scene or later

      Thanks for replying.

      I don’t have any sort of insurance as I am a casual bike rider.
      I did not go to the hospital to check my injuries because the ambulance had disinfected and cleaned my bruises up.

      my cycle was a little bit damaged but it was fixable.
      I decided to pay her after her car was fixed at the garage. But like I said, her insurance company sent me a bill of +£1000. This was news to me because i thought it was settled.

          So the incident wasn’t reported to the police.
          I caused the accident but I believe the third party contributed too. The gap between the car and traffic lights was big.
          she agreed to charge me 400£ which was for the garage repairment.

            So you write back to the insurers telling them that you hold their insured partially liable for the accident, and it was on that basis you agreed to pay £400 in full and final settlement of the incident.

            Don't say she charged you.... you agreed a settlement figure.
            Was that in writing or verbal?
