I Voluntarily terminated my contract with Mercedes and am being chased for over mileage fees.
my questions and issues are-
Mercedes have admitted to a failed collection without notifying me resulting in my taking an additional day unpaid off work. However they won’t compensate my days wage they have only offered to cover less than half a days wage.
Mercedes took over 11 weeks to arrange collection of the vehicle (Due to Covid-19) despite my termination being concluded Just before lockdown. I was instructed to store the vehicle on my drive way and start the engine every week and run it for 30 minutes. I agreed as this was only meant to be for a week whilst BCA arranged collection.
I tried to contact MBFS throughout the 11 week period but could not get through to speak with an agent as staff were furloughed I just got a recorded message.
MBFS are refusing to pay any secure off road storage costs despite insisting on the above.
I had the vehicle for 4 days short of 3 full years but MBFS are only allowing 2 years 11 months mileage. The contract says mileage is pro rata per year and does not say per full month. As I was on 25k miles per year this is a difference of 2000 miles I am not being allowed.
I am being chased to pay £520 for excess miles only as the vehicle was immaculate but feel the above storage and failed collection plus the additional miles more than cover this. I have written to MBFS complaints but apart from the failed collection (that they have not addressed fairly) they are not even prepared to discuss saying their termination offer is final.
Any advice would be greatly appreciated.
