I employed a builder to carry out some work on the house - and the work was badly carried out and left in a dangerous state. I refused to pay and the builder is now taking me to court for the money. The court has allocated the action to the Fast Track process although the amount in question is less than £5,000.00. I yesterday received notification that the builders solicitors have informed the court that their costs will be £19,000.00. Having read various web pages on the internet I am not clear if the judge might apportion these costs between the two parties depending on the truth of their case - or if the loser will be required to pay everything. In the original defence I claimed the cost of repairing or replacing the building work - but I have not completed a cost form for this hearing - should I have done so ??
