  • Restrictions on proprietorship register

    Hi all

    My wife and I were looking to remortgage (home improvements) with a new lender last year and hit a stumbling block when I questioned the conveyancer (pre sign up) how he planned to tackle the restrictions on our title deeds. He insisted they must be paid off as any new lender would want to be top of the list charges Having previously read that these are restrictions and not charges I wasn’t sure his advice was right but long story short we decided not to proceed.

    Fast forward 12 months and we now think we have found a way around this by remortgaging with our current lender.

    The damn restrictions on the title deeds however still trouble me greatly...to the point of causing me mental distress. It just seems so unfair that a lender can turn a sole debt into a claim against a joint asset!

    So my question is:

    Is there a process I can follow to get these removed?
