  • Parking Charge Notice from Parking Eye -Holy Trinity Church Newquay

    Hi,
    I'm new here and need some guidance please.
    I received a parking ticket from Parking Eye on Wednesday 15th July. This was for Holy Trinity Church at Newquay Cornwall.
    I am the registered keeper. The driver had driven into the car park, parked, checked the parking costs and decided not to park there and left. There was no signage upon entering the car park ( from what the driver remembers but is too far to check as they live in south London)
    The arrival time was 16:15 and the departure time was 16:23. The charge is £100 for 7 minutes in the car park. Had there been signage roadside then they would not have parked there. There are local car parks that are free after 4pm and this is what was checked.

    What should I do as I feel this is excessively charged as the hourly rate is £1.30 and feel there should be a grace period for parking, checking signage and deciding whether to stay or not?

    POFA Paragraph 9(2)(b) is stated on the back of the notice.

    Any advice is welcome.

    Can you post up the redacted PCN, but leave dates.Â* Use a hosting site such as imgur and post the links on here.

    There is more than just 1 paragraph required to transfer liability from the driver to the keeper.

    Here's POFA,Â*check that al the required statements are there, especially 9 (2).

            Google Earth shows one sign at entrance mentioning tariff, but so positioned that it could be missed depending on direction of approach

              And the dates were ?Â* I did say leave the dates

              This is PE and unfortunately they do get it right but you can appeal that the driver decided against staying after he had read the conditions.

              The BPA Code of Practise was changed this year (January) to state they must give a minimum of 5 minutes grace for those that decide not to stay.Â* The previous version was a minimum of 10 minutes.

                Sorry, I misread that about the dates. The date of parking was 9th July and the date of the letter is 13th July.
                So as the driver was over the 5 minutes grace period, would an appeal be granted?

                  The 5 minutes is the MINIMUM time.Â* The fact that the driver could not conform to the contract should help.Â* It's up to you, it's a £40 punt.
