  • Shared driveway dispute

I live in the 3rd house of a row of cottages. We have a private lane which leads to all our cottages from a busy main A road. My neighbour who lives in the end cottage owns the lane. For 35 years, I’ve *been reversing out of my drive and onto the lane, then driving forwards to reach the main road. My neighbour has just put up a security bollard which now prevents me from reversing out of my drive onto the lane. I have no choice but to reverse out of my drive out onto the main road, which is illegal. He says he is still allowing access to the property in some way, and I’ve no legal right to be able to reverse out onto the lane. He refuses to take the bollard down or move it to allow me the space to reverse. Not sure what my rights are.*

It is not illegal to reverse onto the main road, just inadvisable.
If there is an incident you might be charged with driving without due care and attention.

Without full details of the easement it is not possible to say whether or not the owner of the servient land is obstructing your rights
