  • Please help, I need advice about rejecting a car after 6 months

    Hi, I hope this finds you all well in these difficult times.

    I would appreciate any help and advice with this. I bought a second hand car in November last year. 2 days after picking it up it developed a fault (engine management light came on, fault with CAT/DPF). I sent a message to the dealership through WhatsApp and got a reply (still have the conversation). After lots of back and forward, having the car for weeks on end, they replaced the CAT and DPF in January this year. During the repair they knocked the sensory for the active cruise control, vw have quoted £500+ to repair. The fault returned almost immediately so I spoke again to the garage. They wanted me to bring it back in to be looked at by a specialist. Then we all got locked down with COVID-19. The garage then where not available to answer calls. In the last three weeks I have been in contact with them. They are trying to dissuade me from trying to return the car. They have offered either to give me £1300 towards fixing the issues and not to contact them again or to return the car and give them £1000.
    what I need to know more about is can I reject the car as it is not fit for purpose or am I stuck with accepting one of their offers. Considering the repairs estimated by the vw garage would be £5500+ and I don’t want to pay them £1000.
    The car is financed, and I have informed the finance company.

    You flagged up the car was unsatisfactory within days of delivery which was in November 2019
    You allowed one attempt at repair which was attempted in January, but left the car with a faulty sensor for the cruise control.
    The fault that was to be repaired returned within a short time
    The car still has not been repaired, and you want to reject it.

    Is the above a correct summary?
    Other than the first request for repair in January , have you requested or agreed to a repair?

    It seems that you are still within the short term right to reject, which gives you the right to a full refund of all monies paid, but it will depend on the timelines and what exactly has been said

      Thank you DES8 that is an accurate summary. Thank you for taking the time to read and respond. They garage are understandably being difficult and not acknowledging the facts. They are trying to dissuade me from the rights I have under the consumers act of 2015.

        So now write to finance house and tell them you are using your short term right to reject the car as per Consumer Rights Act 2015.

        The dealership understandably don't like accepting rejections, as they only want to sell cars.

          Count up the days the car gas been in the garage.* You can total that time to increase the 6 months for rejection without having to show the fault was present initially.**
