  • Witness Statement - right to remain anonymous

    I have given a statement to police and wish to remain anonymous due to threats to my personal safety. I want my statement to just be attached as an exhibit. Is this possible?

    Possible, but unlikely if the case reaches court.

      If you have received threats, either directly or indirectly, or are worried that you may be threatened in the future then you should inform the police. Call 999 if the threat is immediate. They have a duty of care to assess the risk and put relevant control measures in place.

      As for remaining "anonymous" there are procedures to protect the identity of certain witnesses in certain cases. I suggest you contact your police force's Witness Liaison and Care Unit for advice and guidance.

      Also, note that not every statement is used in evidence and not every witness is called to give their oral evidence. There are procedures to redact unused statements etc to remove non-relevant and/or sensitive material that does not lawfully need to be disclosed to the defence. It all depends on the circumstances - again ask the police for advice.
