  • Apprenticeship Redundancy

    Hi All,
    I've been working at my company for 5 years now, and am halfway through a 2 year apprenticeship standard, which commenced Sept 2019. They were asking for volunteers so I asked for information on the package - it's just statutory.
    Now I've done a bit of reading I see that it's a little more complicated, I should be 95% funded through the SFA up to this point, provided that an Apprenticeship Agreement is in place.
    My employer and my provider have been very lax in the HR department, so no commitment statments have been signed, nor have I been presented with, or given the opportunity to sign, an Apprenticeship Agreement.
    Now I'm currently receiving legal advice from a Solicitor (thank you home insurance!) but they don't seem to particularly know about the aprenticeship regulations 2009 etc.
    My question is - as this is a mess, is there anything I should make absolute sure of before I go for redundancy, or not?
    I'm not quite decided as voluntary redundancy with a stat package seems like a raw deal, why wouldn't I just wait a few weeks, get extra pay then get the stat package anyway.

    I've now registered, another question - since no Apprenticeship Agreement is in place, am I employed under an implied Contract of Apprenticeship? Meaning I can't be made redundant anyway without a breach of contract?
