    Hi, I created a thread earlier today but I can't seem to respond to it. I am being chased by Moorcroft for a 20 year mortgage debt that I have not acknowledged or paid. I am not aware of any CCJ for this debt and I have not moved about or withheld my address from Lloyds as I still use the same account with them for some stuff and I have lived at my current address for 20 years.

    Someone has responded to my earlier thread to say a mortgage debt is statute barred after 12 years. My question is, does this still stand if there is a CCJ that I am unaware of. I just want to get everything covered. I have previously asked another debt collection agency to prove this debt and it seems to have been sold on to Moorcroft.

    I checked my Experian credit file and there is nothing there for this debt. Do I still need to check the Tryst site you mentioned, does it hold different information.

        Sorry about that, probably happened while I was dealing with a mass spammer attack earlier!

          I just explained that a CCJ falls off credit file after 6yrs, so if there’s nothing there it’s either very old or never existed. Registry Trust may also have the details recorded. If not - you need to demand Moorcroft evidence the enforceability of this debt.

            Celestine Thank you. If there is a CCJ does this mean it can still be enforced and is it likely that it will be enforced. I actually cannot afford to pay it as I am now unemployed due to the pandemic

              If there is a CCJ it can be enforced - there is no time limit. However, enforcement must be undertaken in a reasonable time frame and if it has been longer than six years, the courts would be unlikely to be supportive of enforcement action. Why do you even think there is a CCJ involved?

                I don't know that there is a CCJ involved. About 18 years ago I redirected the bank/solicitors back to my ex partner as it was a joint mortgage. I don't know if a CCJ was ever issued against him which he's not paid so they are still chasing me for the money. I don't recall ever receiving a CCJ and I'm sure I would remember this and dealt with it at the time if I had. I have also been reading some stuff online which has confused me as there seems to be some conflicting information out there (probably a stupid thing to do).

                  Research is always wise in this situation. It certainly does not sound like there is a CCJ so your approach should be: 'Prove it' to Moorcroft, otherwise tell them to cease contacting you.
