  • Voluntary Termination Case with the Financial Ombusdman for 2 Years!!!!

    Hi, everyone,

I was wondering if anyone was in the same boat as me? I Voluntarily Terminated my PCP agreement with Alphera FS over two years ago. I followed all the guidelines on here, didn't sign any forms etc. They raised an invoice for excess mileage and damage charges which I disputed. It has now been with the FO for almost two years. Any time I contact them they just say they're dealing with thousands of similar complaints and don't yet have a decision on my case. I missed the deadline (by 3 weeks) to escalate this to their complaints person. I even asked my MP to get involved with no luck.

The debt chasers have given up since I told them this so I am not being pressured to make payment in any way. The BIG ISSUE is that they have marked this as a default on my Experian Credit file. Oddly it doesn't show this way on my Equifax or Transunion credit file. The upshot is that I can't remortgage and it's really starting to impact my life in other areas.

The FO has said that they have been dealing with this on a lender by lender basis and have responded to some claimants but have not looked at Alphera/BMW yet. Anyone had a similar experience and had a reply?

    Thanks in advance.

    Iain
