  • Letters from drydensfairfax Solicators

    Hello
I have been paying drydens for nearly 8 years , but just recently they are now threatening me with possible legal action, l have never missed a payment and all seemed well.
This debt is one of many old debts I had dating back to about 2008 when I began to default and miss payments.
I cannot be sure but I believe drydens may be the third people to have taken this debt on.
I have managed to now clear most of these original debts including two that became CCJ'S these when I couldn't cope with the constant pressure I was receiving so agreed to the debt being secured to my property.
One of these CCJ'S was at that time also drydens.
I now only have two of these old debts left, neither are CCJ'S one is with Cabot, and one with drydens.
I will be honest that over the last few years I have worked hard and built a good credit rating. I cleared the CCJ'S and all the other debts now may be foolishly I should have cleared the debt in question, but I couldn't forget the aggression, nastiness or stress they caused me.
I naively believed I could just continue paying as I had.
Now i have found out they may pursue legal action, but due to some bad health news that will be life changing i have only just opened the letters, this being because i have been in and out of hospital. I was first admitted March 13th.
One stated that they believed that i could pay the debt of quicker from information on my credit file.
I did not ever give permission for them to search , i have check my reports and it appears that arrow global carried out two searches in December last.
The first letter I received was march 20th, I the recieved another early April both requesting I fill in an income and expenditure report. I then recieved a third mid april requesting the same again but this time they would be going to ask the creditor arrow global to if they wish to start legal proceedings, I was given to april 28th to return the income/ expenditure or get in touch.
I obviously have not been in touch as it was only yesterday when i finally opened all my back dates post, this being the first opportunity since i started my treatment.
I have not yet recieved any more letters, and was looking for any possible advice or guidance.
One issue is that since February this year my whole financial situation and long outlook in regards to priorities has changed and I am no longer in a position to pay any more or put myself through the stress of fighting of aggressive debt collectors, I appreciate this may be selfish and my own fault, but I would gratefully appreciate any guidance recieved.
Having briefly looked up, question I have are
Is it worth asking for the CCA
Will I have chance to negotiate if I can source money from somewhere.
Will they already put me in court
Do i make contact or just wait and keep paying.
Again any advice would both good or bad.
    Yours Faithfully
