  • Mercedes Finance Issues

Have recently handed back a pcp with Mercedes, 15 days before end of the contract, I purchased a new PCP with Mercedes, cancelled my direct debit, MB now chasing me for full payment for March (I gave it back 14 days early), I was advised that I was eligible to pay this as the car wasn’t part exchanged (No equity), this wasn’t explained to me by MB when they called to ask when I was handing car back. *Worst of it is the new car I bought with 4,000 miles, hadn’t been serviced, valeted (when it should have been), Spent 2 weeks before lock down in and out of the garage with various issues (there is still outstanding repairs on the bodywork as the garage closed). *Have tried explaining all of this to MB, customer service is terrible. *Was told today that a ‘not nice’ worded letter is on its way to me even though I have been emailing them trying to resolve. * Can I be taken to court for this? *Will it go in my record (I’ve never had a default or paid anything late in my life), this was/is a genuine misunderstanding, had I known this I would have handed my car back on the final day it was due to be returned rather than pay for 2 cars (neither that I had!). *
    Advice appreciated please.

I have also put a case in with the ombudsman as when I bought the car I took in a 12k mileage allowance, this wasn’t on the adequate explanations document I took home (it’s in my new car finance document) I disputed it and MB sent me adequate explanations document along with a HP agreement with a tiny bullet on the bottom advising it was 10k Miles (I never saw this and wasn’t given a copy of this when I left with the car). *Complaint rant upheld and I have escalated to FO, again, all in good faith when I could have VT the car with no additional cost, have paid 47 months and 2 weeks out of a 48 month agreement. *Absolutely scunnered with it all and the usual salesmen at the time (when I asked about exceeding mileage) telling me at the time that if I went over mileage would be ‘waived’ if I bought another MB!!!*
