    i am being made redundant and my employer is trying to railroad me into accepting a settlement. my company has been through 3 mergers at the 1st my continuous service date of 01/10/2012 was signed on 06/2015. A Tupe contract was then issued with a continuous service date on 01/10/2008 signed 09/2016 a Subsequent harmonisation contract was issued with continuous service date of 01/10/2008 signed last year. They are saying my tupe contract was issued an incorrect continuous service date and to calculate payment from the 1 date. i signed the contracts in the belief i was getting enhanced conditions on merger but they are trying to force me to accept original can they do that? or do they have to honour the contract?

    When did you in fact start with the first company? That is the date from which your continuous employment started and from which your redundancy payments will be calculated for length of service. Changing an employee's start date to an earlier date for the purpose of continuous employment would never be something that would be done as an enhancement on a merger. In fact it is something you should have queried at the time as it would have been an administrative error.
