  • My conveyance solicitor refuses to give my solicitor access to the full file

    In 2014, my conveyance solicitor totally missed the fact that an overarching planning condition existed on the property I was going to buy. Unaware, I paid a premium for the property. The condition restricted use. When I found out about the planning condition in 2016 and contacted the conveyance solicitor, she fudged the issue and sent over two very dubious looking hand-written telephone attendance notes with the words 'pp' (planning permission) on one of them to try to prove that she had spoken to me about it on the phone. I began legal proceedings against the firm for failure to instruct on the condition. My solicitor repeatedly asked the firm for a full copy of the 2014 conveyance file and they refused. They would only supply the 'official documents' (plans, titles, searches etc) but refused to hand over any correspondence with me or any other telephone / attendance notes etc. How can I get my file?
