  • Divorce and cheating

My husband and I have children but I saw him cheating and told him that I wanted divorce on that reason. He said that I will not get it cause I don't have a proof. On the forum found some people use spying apps like this mspylite.com . If I show his messages on phone with the help of this app in the court can it be a substantial reason?

The only grounds for divorce is that the marriage has irretrievably broken down. There are five ways, known as the five facts, of demonstrating that the marriage has irretrievably broken down. One of the following has to be proved:
    adultery
    unreasonable behaviour
    desertion
    two years separation with consent
    five years separation without consent
If one of the partners does not agree to divorce, and decides to defend it, it is called; defended divorce and will require the help of solicitors. Mediation will have had to be seen to have taken place before any court hearing.

The changes proposed by the Justice Secretary on 9 April 2019 would establish a minimum six-month time frame to enable couples to “reflect” on their decision. Currently named The Divorce, Dissolution and Separation Bill, the new divorce laws would also abolish the ability to contest a divorce. New Divorce Laws UK | When Are They Coming Into Force?
