  • RWAY/HOIST -Barclaycard

    Hi

    Not sure what to do here I have an old account that will be off my credit report in October 2020 ish

    balance under 7k
    this was an old Egg card 2002 then Barclaycard.

    I have had an email from RW offering discount 50% off etc
    last payment / acknowledgement was Feb 2014 to Barclaycard

    Default Oct 2014

    There is also a repeat of this default from Hoist so have 2 defaulted accounts for the same debt with one being Barclays the other Hoist - is this normal (?)

    To try to clean things up before I might be able to buy a house next year, I don't know if by paying it that acknowledged payment stays on the credit file for 6 more years although partialluly s
    ettled? Or does it drop off.

    Also is it possible that i could get the extra one these defaults removed ?

      Hi - Firstly, Hoist have purchased the debt from Barclays - the defaults on your credit file should reflect that but in reality you only have one default. It's usual to see the original creditor and then the new owners showing in this manner.
      The default will 'fall off' after 6 years, sometime later this year. What you now need to avoid is Hoist escalating this to court action before the limitation period expires. You should consider sending CCA request to Hoist to check that the original paperwork is all in order. A 2002 account may well have serious enforceability issues. It would be useful to know this before getting into settlement negotiations.
      "Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. For example, the pion is invariant under the restricted Lorentz group, but is an isospin triplet (meaning it transforms like a three component vector under the SU(2) isospin symmetry).         I think Celestine is advising is to send a SAR request to HOIST first, this will show if they have a copy of the original application showing your signature. Also one to Barclays.

            Sorry forgot to add
            the Bcard account shows the account default as September but Hoist shows the default at later default date of November but its the same debt /amount ect just a difference in default dates which is really confusing me.

                I sent CCA request many times in last 2 years but I just get Terms & Conditions, and now 6 years has passed.

                  First of all, has Hoist threatened a court claim?
                  A 2002 account should have produced a signed copy of the original agreement. What has Hoist said to you about these CCA requests?
                  There is considerable debate on whether the clock starts ticking from when the last payment was made or when the account was defaulted. I would feel more comfortable assuming that your account is time barred later this year.

                    Many thanks for fast response .I got a pre-action protocol form twice in 2 years and I filled in and sent and each time and I aksed for CCA and they did not provide. They confirmed they can not get CCA but confirmed last payment date which is March 2012. They threatened a court claim before and I followed up wit CCA letters. The account is from 2003 and defaluted more than 7 years ago and dropped off from credit file.

                      I'm getting a little muddled! You mention an Egg card last paid in 2014, did you mean then, not 2012 as per your last post.
                      OK, so they've confirmed no CCA - so they will not be able to enforce this account through court, that's probably why you've not received a court claim. Plus it is already or about to go time barred. Respond to any further communication with a firm but polite, 'you have failed to comply with my CCA request, the account is unenforceable, please cease contacting me'
                      Credit file should start to improve next year.

                          Hi Guys,

                          Hope everyone is doing well.

                          Just a quick question:

                          I had a credit card debt form 2002 and this debt has been sold many times over and the last payment made to this debt was over 7 years ago. Then 2020 was sold to a new company and I never paid them. But I wrote to them for proof of last payment.



                          I would like to to know the meaning of 'written contact' because I only asked the last debt management comapny to provide evidance of the last payment which was told 7 years ago.

                          I wrote to them once to ask for evidance of the debt and last payment.

                          I never admitted to owe the debt


                          Now the debt has been sold to another again!!

                          I understand it is statute barred but I wrote to last comany 4 years ago.

                          So is this statute barred or not? because I wrote to them 4 years?

                            If you are sure, that the last payment and their hasn't been any communications admitting the debt in writing over the last 6 years, then send the following letter, make sure you get Proof of Postage.

                              Hi,

                              Many thanks for fast reply. I only wrote to them 4 years ago to ask for proof and never admitted owing any money to them. So am I still ok to send this letter?
