  • Legal Aid

Hi everyone again. I asked yesterday regarding possible legal aid for my Daughter and if we need to go through a Solicitor to gain it. I did receive two responses, and I thank you for that. There was a suggestion that I should say more regarding the case for perhaps extra advice to be given. I cannot go into too much detail, but my Daughter is pursuing a case against the Police. Please do not think we are some kind of compensation riders. I assure you that is absolutely not the case. I cannot mention details too much only to say my Daughter ended up completely naked in a Police cell in front of 4-5 male officers after having her clothing cut from her with scissors and ripped to shreds. This is a girl who only goes out of her door 2-3 times a year socially, and she has never been in trouble in her life. The preceding incident has shocked and utterly distressed my Daughter. She was brutally raped aged 16, and this event in the Police cell has obviously made her already fragile persona even more challenging. We simply cannot let it go. This is shocking. The whole family is still reeling from this. I really just need to know if we can claim Legal Aid without going via a Solicitor? Also, if we can secure Legal Aid, and the case is lost, will we be liable for costs? Please do not judge me/us on what I have said. We are a family whom have never had any trouble whatsoever in our entire lives. We have always adhered to the law. This has shattered all of us, and we just have to see it through, for my Daughter's sake.

It becomes confusing if you have multiple threads, and posts can easily be missed.

As this is a civil case, and your daughter does not want to engage the services of a solicitor, what costs (other than court fees) do you anticipate meeting?
As a litigant in person she might be eligible for legal aid to pay for professional advice (https://www.gov.uk/represent-yourself-in-court)

Regarding adverse costs, in some instances Legal Aid Agency does cover these, but you should check with the agency .
