  • CCJ Discharged?

    Hello Amethyst ,

    I was checking the CCJs (egistered May 2016) on my ClearScore account and noticed their status had changed from "Active" -> "Discharged". What does this mean? And what is the implication of this - how will it affect me? What does this mean for the debt and DCA?

    Their current status is "Unsatisfied".

    CCJ's expire on your credit file after 6 years, so your creditworthiness will slowly improve. However, the creditor can still enforce the judgment against you if they locate you so it does not make masses of difference to the DCA's.

      Presumably after 6 years, they are still enforceable if still unsatisfied?

      I would like to get this resolved as it has been haunting me for a while (and causing a whole lot of bother) and would like a full and final settlement to finish this. I have been offered some support from family that will clear 25% of outstanding (c. £22k) - do you think this would work? what's the best way of getting this through? Is it worth going through someone like Payplan who may be able to push instead of going direct?

      @ Everyone else reading this post: I believe some of the terminology ClearScore uses can be misleading - so it's best to check with Registry Trust.

        Presumably you have managed to 'avoid' the DCA's for over 6 years? I'm guessing you therefore do not own a property?
        That's how they get you eventually. If your name suddenly appears on credit files with secured lending such as a mortgage, the DCA would apply to enforce the debt via a charging order or possibly even bankruptcy given the amount involved.*
        If you are planning on continuing a nomadic lifestyle (!) there will be very little any DCA can do to physically make you pay this debt, you've journeyed through the period of severe credit file damage. What you do next depends on your life plans.*
        If you are still semi invisible, you can safely contact the creditor to discuss settlement, however make sure you withhold your number and give them no information apart from account number and address that they know of. They may refuse to deal with you if they can't prove who you are so this can be a little tricky, but if you're able to give 'an' address, a DOB and the relevant account numbers, they should discuss settlement directly with you. It may be wise to set up an email through which you can communicate with them beyond this point. Your initial call will definitely get them excited and they will want to follow up :/ 25% at this stage, especially when they don't actually know where you are, I suspect they'd take it.

          The CCJs were registered in May 2016 (by default as I was living abroad and missed correspondence) but I had been in touch with them several times over the past few years but was unfortunately not in a position to pay/contribute based on my circumstances... So i have 2 years left before it drops off my credit file, even beyond this they will still stay enforceable through court?

          Based on the above, you still feel that I can offer 25% to get this resolved? (my situation is exacerbated by coronavirus and being furloughed)

          Unfortunately this has caused a lot of damage for mortgages which is rather frustrating (and also difficulty in renting).

          I have an email which I have communicated with them - should I initiate contact by call or email?
