  • Notice of proposed allocation to the small claims track

    Hi* *
I received a notice of proposed allocation to the small claims track but I'm not sure how I should respond to this form.I am the defendant as previously mentioned in posts that I sent in which I got very helpful responses.* Could I kindly also get some advise on this please. Some of the questions in the directions questionnaire below are:
    *
A1 -* Do I tick "Yes or No" to agreeing for the claim to go to the small claims meditation Service?

D1 - In answer to the County court centre I prefer -* Could I request it be one held near me as it also asks why I prefer the chosen county court

D2 & D3 - Regarding Expert evidence and Witnesses I am not expecting I need to use anyone but I'm not sure what is expected of me in answering this question

Also the part that mentions would you like to settle your case without going to a court hearing?
Under "Please consider the following statements"* * - " The part that states "I can confirm that I have enough information about the claim, to allow me to enter into negotiations" - I don't believe I do have enough information because the credit agreement (contract) that I asked the claimant to send has not been sent . So am I to tick yes or No to this question cos I'm not too sure how I should answer this question.

Finally as well as sending my answers to the directions* questionnaire to the court am I also to send an answer to the directions questionnaire to the Claimant?

Thank you for your anticipated assistance.

I have a court date next month regarding a small claim. In the witness bundle sent by the claimant correspondence between myself and the claimant who are PRA has been included but I have noted that they have omitted to include one letter that I wrote and I am of the belief that this letter is vital to help my case this letter is to do with the £1.00 cheque I sent to request for the original copy of the contract.. I have proof that it was sent to them because I have the receipt of the registered post. PRA did send a document to me but it was illegible so I think they are trying to get out of the fact that the contract was requested in accordance with the Act. I also showed the agreement sent on a thread and there was consensus it was illegible but for some reason I can;t see the thread to link what I'm writing about now.. Could I kindly ask how I can get this letter that the claimant did not include in their witness bundle across to the court as I can see they are only focusing on the assignment and not the contract. Could I also know if there is also away I can ask for the case to be struck out because the document sent as the credit agreement is illegible? Your response would be much appreciated, Thank you
