  • declaring spent convictions on the job application

    Hello.
I have very recently been refused job because I haven't declared my spent conviction.. They found out through the reference from my current employer. The reason why my pre-employment checks were unsatisfactory was apparently me being dishonest which was not deliberate. The reason why I havent declared my spent convictions is because I simply thought I didn't have to ,once spent, by law.. I'm not entirely sure whether the job I applied for is exempt from ROA but even if it was the nature of my condition which is DR10 is apparently still classed as spent therefore I don't have to declare it..The job I applied for is to work with vulnerable adults. I have tried to explain the whole situation but the employer is having none of it. They just basically keep saying its not the actual conviction which is the problem but the fact I said I haven't committed any in the past which is untrue. My enhanced DBS also came back clear.. Have I got any rights at all? I just feel very upset over all of this and all the info online is very confusing... thanks for help

Working with vulnerable adults is exempt from ROA

Don't know what the exact wording of your application was, but I doubt the actual offences would have caused you to fail.

In the end I doubt there is anything you can do, except be more aware next time
