  • Privacy Notice as opposed to PCN

    Please see attached. The driver had one of these left on the car and thought it was just a telling off, the driver subsequently threw it away and is now going to court to fight the charge.

    Question is - does this have the same status as a PCN? What's the difference? Anything else to note?

    It is NOT a PCN. They are hoping the driver will respond and so they will know the driver and not spend money contacting the DVLA. Edit your post so that the identity of the driver is not inferred, use "the driver...."etc.

    Have you received any other documents

    Have you recently moved house and not changed the details on your V5?

      Ostell, thanks for your reply and continued patience re 'the driver'

      We have conversed before on '1518622-new-private-road-parking-charge'

      The driver received the SAR and it confirmed there was no PCN just a privacy notice. This was how the driver of the vehicle remembered getting an 'odd' privacy notice on the vehicle and thinking it was not a PCN.

        The keeper received the SAR?* So there was no Notice to keeper sent?* Therefore if the driver wasn't known then they cannot transfer liability to the keeper.

        What exactly do you mean by going to court?

          Ostell.

          The car had a privacy notice on it.
          The keeper then rec'd a notice to keeper
          This has gone through the motions and is now at CCJ stage (hence my court reference)
          The keeper has submitted a defense
          The keeper has just sent off the Small Claims Track

            The ticket on the windscreen is irrelevant.* What matters is the Notice to Keeper received later.* It should have been received by the keeper within 14 days and complied with POFA. to be able to hold the keeper liable.
