  • Promissory Estoppel -

    *I am an agent acting for a landlord. *In accordance with current law I took a holding deposit on property equivalent to one weeks rent. *I subsequently carried out references which the applicants passed. *The same applicants subsequently withdrew an offer they had on another property with another agent and lost their holding deposit. My client, for reasons to do with Covid-19, requiring to isolate one of his family in the subject property, withdrew the property from the applicants. Of course their deposit will be returned, *but they also want me to reimburse the lost deposit on the other property citing promissory estoppel which I do have some understanding of and thus I feel it does not apply hers - any thoughts?

    Promissory estoppel can only be used as a shield not a sword so the applicants aren't going to go very far with that argument.*

    They may have an argument that if they were informed that the reference checkes were successful and relied on that statement in withdrawing their other deposit, they might have a case for losses incurred. Equally, if you put two sets of deposits down then you are ultimately going to lose one anyway by withdrawing one of them, so it really depends on the facts here.
