    Hi, I have received a County Court Claim form for non-payment of a parking charge which i intend to defend. In the 'particulars of claim it states that 'the driver agreed to pay within 28 days but did not'. - I never agreed to pay them - would this be something to mention in my defence and is this significant?

    The situation was I was in my vehicle waiting to park. I never left my vehicle. Eventually I parked but got a 'ticket' for not parking in a designated space ie during the time i was waiting for a space. My defence is : I wasn't parked I was waiting to park*

      The signs, which are the contract, will say that payment within 28 days is required.

      Look for the Fistral case where the judge decided that waiting for a space is not parking


      Acknowledge the claim on line using the details and password on the form, nothing in the defence.* Do this just after day 5 and you have 33 days from the issue date to get your defence to the court
