Hi, I would like to ask whether, if you have had continuous and uninterrupted occupation of a piece of land and you have looked after that piece of land*for over 9 years, is it possible to take ownership of it - we are in Scotland?*
I have explained the background to this below*- we*bought a plot of land in September 2010, during that time until present day we have had continuous and uninterrupted occupation, tending and keeping the entire plot.* We had to provide proof of this during 2018*when our neighbour tried to land grab a section of our plot along the joint boundary.*
The boundary between our neighbour, who moved in a year or so after we bought our plot, is marked on the land by a straight fence and 15ft hedge.* The boundary marked on the missives shows the same boundary but*has a dog-leg marked at the bottom of the boundary, which is not represented on the plot and has never been so,*as long as we have owned it, and since the neighbours moved in.**The fence runs from the top to the bottom of the plot, the dog-leg on the drawing is at the bottom of the plot, it cuts a small corner off the bottom of what is our current plot/garden, having now built a house. ************************************************** **********************
The line marked on the missives representing the boundary between our plots was incorrectly drawn, this has been proven,*the line was drawn at an angle rather than straight, which made it appear that our neighbour owned a strip of our land.* Although we explained this was a mistake to our neighbour; showed him our title deeds which includes accurate land measurements, proving the drawing was incorrect; three solicitors verified that the line drawing was incorrect and the written information in or title deeds was correct, our neighbours refused to agree to rectification, as suggested by Registers of Scotland, and instead engaged a lawyer. Unfortunately we too had to engage a solicitor to prove our ownership, to stop our neighbour land grabbing and being forced to buy our own land back. *
We were able to produce photographs and video which proved legally and conclusively that we owned all of the plot.
We received a full apology from the registers of*Scotland, they remeasured the plot and issued updated line drawings as part of the title deed. *
However since that time, a further two years,we have now built a house and have continued to look after the entire plot including the dog-leg section, and wonder whether we can claim ownership of the land?
