  • Hello - How do I apply to get a defence put aside

    Hi there, *I am taking a company to small claims court. *They filed an acknowledgment of service, but then didin't put in a defence in the required time so I've applied for a CCJ against them. *Then they submitted a defence about 6 days late. * Under the circumstances can I apply to have their defence set aside and if so, how do I do it?

    The chances are the Court may allow their defence unless you been granted your CCJ in which case it will be them who would have to file for a Set Aside? If their defence has been accepted - have they sent you a copy - then you may reply to the Court about its contents.

      How do I reply to the Court? *I started this with the online service, but their Defence was made in writing because they missed the deadline. *Do I have to use a special Form?
