Unfair Relationship Claim

Hi All, My other half has made an unfair relationship claim on HSBC (Old HFC Card) and they have turned it down, saying that her card start and end dates were outside those specified in the Plevin ruling. She has taken it to FOS who have merely backed up HSBC. I was under the impression that under the Consumer Credit Act s140 an unfair relationship case was had no start or end dates. Does anyone out there have an opinion or previous experience of something like this.
