    I had my car stolen and it’s now been written off, my insurance offered me a price but then found a speeding fine from one of my named drivers and reduced it by £4000 and saying that I was then only 64% insured, does anyone know what GAP will do about this? Will they void the gap insurance?

    I'm more interested in the insurers reason for reducing the indemnity by £4000 when the non disclosure of a possible driving conviction probably has no affect on that part of the premium applying to theft.
    Also wonder what the wording on the proposal form was.
    If it asked about "convictions" and the driver had accepted a "Fixed Penalty", there is no conviction!

    Was the driver with the points on licence the last driver before the vehicle was stolen?

    Was the non disclosure deliberate or accidental or inadvertent?

    If the insurer would still have entered into the contract knowing about the "conviction" but the premium would have been different, then the insurer may*reduce proportionately the amount to be paid on a claim, by reference to the percentage relationship between the premium actually charged and that which would have been charged had a fair presentation been provided.
