  • Gardsman insruance mis selling

    HI All,

    just wondering if anyone can give me legal advice on the below issue*

    so me and my wife purchased a sofa from DFS about 6 months ago when buying the sofa the sales man sold us guardsman insurance telling us if anything happened to the sofa in any way then guardsman would cover us and i had asked him what would happen if a spill or damage happened to the sofa he had told us that they would asses it and then they would try there best to match the colour of the sofa and if they could not they would re upholster the sofa*

    So 6 months later my wife’s cat has taken a liking to the sofa in question and ripped a number of holes in a few different places on the sofa, so we made a claim through guardsman to get them to fix it they asked for photos which we then provided to them and basically they sent a letter saying that they would do 1 of 2 options*
    option 1: they would try to repair the damage to the sofa but could not guantree anything like if the colours would match or anything like that*
    option 2: they would give us a cash settlement of about £150 when the sofa is over £1000 if you bought it new*

    I had made a complaint firstly outlining that the amount they had offered was not acceptable because the damage to the sofa is extensive and to replace the sofa would cost a lot more than what is being offered. also i had told them what we had been told when buying the insurance and now we were claiming we were being told something completely different and in my opinion this was misleading and miss selling as DFS had acted as a broker for guardsman when we had bought the sofa*

    There response after looking into the issue was telling me to go back to the retailer and they would not help any further with the issue*

    My question of the group is this right? do i have to contact the retailer or do guardsman have responsibility for what we were told in store by essentially one of there brokers? also what else can i do about this to get my issue fixed?
