  • Executor refusing to pay

    My nan passed away 16 years ago and has felt money to who my uncle the executor of the will is refusing to pay me I was meant to receive it when I turned 21 but no one had sold me that I am now 23* and have been told in december 2019 I should of had it when I was 21 and now my uncle is refusing to pay and is thrown* every excuse possible* to me as to why he won't and will not give me what was left to me he has a solicitor and I do to but he is just refusing and now apparently he needs paperwork saying that I will not chance him in 5 years time for more money* until he receved this paper work he will not give me what I am owed* I also have a copy of the will so I know what is left to me* please help* thank you*

    You know what has been left to you, but what does the will say about your legacy?

    The will has set up a trust, presumably naming your uncle as trustee
    Did the will say what powers the trustee would have?
    If not his powers will be determined by statute - the Trustee Act 1925 and the Trustee Act 2000 -

    You haven't given much information, but it seems there may be a breach of fiduciary duty by your uncle.
    This would be grounds to apply to the court for his removal and appointment of a replacement (who could then wind the trust up)
