    Three years ago, the council tower block in which I live had a conciergerie that monitored the interior and the immediate exterior of the building using CCTV cameras. If there was an incident, the concierge could not only view incidents in real-time but also, playback an incident. The playback facility was very useful, particularly to the police who if in attendance, could request the concierge play-back the incident too quickly forward n investigation. This playback facility' has now been removed due to data protection law. The police and authorised council staff when investigating an incident, now have to apply to a central unite to view a past incident. Can data protection legislation apply to this situation in this way?

    Yes, the data is subject to data Protection but if the concierge is identified to the ICO then he can access it but must not allow others to view the images apart from the police while investigating an alleged incident.
