  • 2nd defendant issues

    I have gained a default judgement on a 1st defendant. I had to do it manually as the MCOL service would not let me do it as the 2nd defendant had filed a defense. However when I spoke to the small claims office, they said the 2nd defendant had not signed their defense so it had been sent back to them This was about 5 weeks ago and my question is, can I make an application to the courts to request judgment on the 2nd defendant as they are now just leaving their defense in the system and not replying to it or completing it. It seems they have discovered a loophole and are now just sitting tight.*
