June 2016 -parked and paid in a VCS owned car park. Paid 4.50 daily parking by phone app, but selected my car reg instead of my husbands. Did this on two consecutive days. (I park so frequently that I memorised the options so I just pressed the numbers to advance to the payment.)
Moved house in Jan 2016 so have a new address but post was forwarded. Received letter advising of fine. Contacted VCS, explained the above. Received a second letter asking for a £10 cancellation fee. Paid it. Thought we were done.
Then received letters from BW Legal demanding payment of £185. The cancellation fee was only for one of the dates - even though all of my communication included both references- so I was being pursued for not paying the parking charge.
I refused to pay, having in good faith, resolved the issue with VCS. I also argued it was disproportionate, especially as the company had not suffered a loss- I paid for parking albeit fornthe wrong reg. I don't see them contacting me to give back the money fornthe car that wasn't parked there! In truth I would have paid a cancellation fee had I been given opportunity.
I Also informed VCS and BW Legal that I, not the registered keepe, was responsible. I informed of my new address and chased them for updates.
I received no communication from the company after 2018.
My husband was recently refused credit. We discovered last night a CCJ was made without our knowledge in July 2019.
Do I have a reasonable defence to apply to have the CCJ set aside?
