My son took out car finance and I acted as guarantor. He kept getting behind in payments to which I had to step in and pay. He got caught up but some months later it happened again, he decided to give the car back. I emailed finance company and asked what the process was he had paid well over half of the finance, I had no response initially from finance company other than receiving arrears letters. I emailed them again requesting what the process was and they said they need to discuss with my son, which they did and sent the forms out for him to fill in. They recovered the car and sold it on. I received an email in August stating there was a shortfall for the remainder of the finance balance so I agreed to set up a standing order with them, this was set up and 1st payment came out in September as agreed and subsequently each month after that, however they keep logging missed payments against my credit score, when I asked them why they said as they had already terminated the agreement they are entitled to log missed payments. I asked for a copy of the termination which she emailed to me but I had not received this and was unaware it had been terminated about a year before, they had never asked for the return of the vehicle or sent the debt to court or mentioned this in any phone calls. Where do I stand, I have no problem paying this back but find it unfare they are logging missed payments from his original arrears on my credit score. What can I do.?
