    Hi I really need some advice.

    I have a son from a previous relationship and am about to get married again later in the year.

    I already own a property and have some savings which I would like to leave to my son when I die.

    Also I would like to protect these assets if I ever became divorced in the future.

    I really don’t know how to go about this does anyone have any advice? Thanks Tasha

    The most obvious first step if you wish to leave certain assets to someone in your will other than your wife, would be to make a will stipulating the assets you wish to give to each beneficiary.
    Regarding your forthcoming nuptials, a pre-nuptial agreement may be the way to go. However, re-nuptial agreements are not enforceable in UK courts, but recent case law has shown that judges are prepared to give them substantial weight and uphold them as long as certain precautionary steps were taken when the agreement was drawn up and signed.
    A discretionary trust created in your lifetime as a way of protecting your family’s assets in the future. *An increasing number of people have used discretionary trusts to reduce the risk of losing capital assets.
    These remedies can be complex and I would suggest you consulting a solicitor to discuss your options.
