  • Bailiffs due - CCJ - Letters not received

    My son was sent a PCN for going in a bus lane that had just been declared as having insufficient notices by the courts. He, therefore sent an email to challenge the PCN and got an automated receipt for the email. He never heard back and presumed they had decided not to pursue, when the time limit elapsed. Many months later, he has received a notice saying he has received a CCJ and if he doesn't pay, the bailiffs will come. We have done some research and believe he needs to send a PE3 and a PE2? He was still at the same address when the time limit expired, but moved address since then - he informed the DVLA. He received no emails or letters prior to receiving the bailiff's letter. How can he get the evidence that was put before the court - surely they would have had to show that they had contacted him (or not)? Also, if he pays the fine as it stands now, can he still proceed to fight the CCJ? It is the CCJ that he is most bothered about. Many thanks in advance for any advice.

    Is this for a Council ticket - if so then there is no CCJ.
