  • Limited company

Hi, looking for some advice please. My partner has a limited company, registered to our home address. The business is failing and has been issued a CCJ. What happens now, can bailiffs turn up at our home? (I have never been in this situation before so really don’t know what happens next) His name is not on the mortgage, as I lived here long before I met him. Can any claim be made against property, is our home at risk?*
    Many thanks.

Ltd as the word states, A company that has filed to become Ltd means exactly that, there will be shares issued, normally one share each to the Director and the Secretary, the Company would be normally Ltd to liability of £100, that is what the Company is libel for. And so the CCJ that has been granted will only be libel for the £100. Bailiffs can call and demand payment of the £100, or you can declare the Company Bankrupt.*

The issued share capital is* completely irrelevant to the issue.* As far as I understand it no claim can be made against the property, it's* not owned by the company.* They may try to threaten to remove other items, such as cars, computers tvs etc so start getting together receipts for higher valued goods in the home to show that they are not part of the company's assets*
