  • Letter from debt company asking for income expenditure after court has ruled

    Hi I hope you can give some advice. I had a debt for a credit card which was £380 with charges. I accepted the debt in a reply to the court but stated I disputed costs, as I never received the letter from the debt company before the debt got to court. It was a county court.

    After I submitted my part admittance, I heard nothing for some time and contacted the court. The court advised me the case had been 'stayed' as the debt company had not responded to them in time about the offer and the debt company would need to make a payment to them a fee to re open the matter.

    In January I received a letter from the court advising me I would need to make the monthly payment I had offered, however the court have considered the whole debt and not the part I admitted (which was basically the debt minus the costs).
    I assume this as they believe the company is entitled to the costs anyway despite I said I did not receive the letter about going to court in the first place from them.

    Then a few days ago in a letter dated sometime after the letter from the court, I received a letter from the debt company.

    Which states "We note that no recent payment have been received towards the outstanding balance ... Enclosed is an income and expenditure form which you need to complete and return to us within 14 days".

    Now I just wonder if this would be ground to have the ruling of the court turned over? Or what this means for me? If anything....

    The letter I received from the court was dated around 30th of Jan. The letter from the debt company completing ignoring any court proceedings or ruling is dated just 2 days ago.

      you mean the court did not let you know the case was un stayed???
