  • Gemini parking charge notice

    Hello. The driver received a parking charge from Gemini parking, The blue badge was displayed, The driver received the charge whilst parking at Queen Elizabeth Olympic Park, there Is an area that has lots of disabled bays there were all taken so The driver parked next to the bays but was not obstruction any access, The driver did check for any signage but didn't see anything, but cannot be 100 % certain, they are saying the driver parked on private land and not parked in a marked bay. Any advice help much appreciated, thank you in advance.. The driver has attached the parking charge notice, The driver does not have much time before the reduced fine needs to be paid.

      Edit you post so that the identity of the driver cannot be inferred, use " the driver.........." etc

      Blue badge does not exempt the driver from complying with the conditions or paying

      Dear Sirs,

      I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

      You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. *You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

      There is no legal requirement to name the driver at the time and I will not be doing so.

      I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

      Send so that it arrives just after 14 days from the parking so they can't correctin time.* Send first class mail with free certificate of posting from any post office

      They will, no doubt, reject but will provide a POPLA number and when you add in all the other failures then your appeal will be successful

      No period of parking
      Creditor not identified
      Keeper liability warning incorrect
      No statement that the driver is liable for the charge

        Thank you Ostell for your reply , I have amended the post as suggested, I respect to sending the post via Royal Mail etc, this is not possible as I am out of the country now, would an email sent on the 14th day be acceptable...

          Another question Ostell, the 14th day would be the 6th Feb, do I post on the 14 day the 6th or the day before as it says to pay within 14 days of letter, thank you for your help

            The timing is so that they cannot reissue a corrected NTK to arrive before day 14

              Thank you Ostell, I have got someone to post letter from UK, is the 14th day from the date of the letter or when I received it ? So if I post today they will receive on the 14th day and will not be able to reissue a NTK to arrive before the 14th day is the correct, sorry for all the questions and confusion. *Your help is much appreciated*

                  Thank you *the contravention date was the 18/1/20 , I received the notice on the 24th , so if it's 14 days from the event I have well passed the time, so should I still post the letter ?*

                    Morning Ostell, if you could please answer this question as I'm getting a bit confused , I'm not sure where I stand re payment. *I sent the formatted letter yesterday with proof of posting as advised, but am concerned now from you last reply saying the 14 day is from the date of the offence that was on the 18/1/20, not the date of letter, so therefore am I out or the 14th day response time and therefore the letter is invalidated. *It's just the 14th day to pay reduced fine is today . *Many thanks in your continued help*

                      The 14 days from the alleged breach is so that they can't correct their error and resend.* It's past the 14 days now so not a problem.

                      It's not a fine it's just an invoice and the discount period is just to get you worried and pay promptly.
