Im a council tenant and have been taken to court for feeding pigeons in my own back garden. I live in a block of four flats and the upstairs properties are leaseholds. The council have got the two leaseholders to provide the witness statements of the alleged feeding.I submitted sensitive documents about my mental health in defense of the allegations and the council I believe have shown the leaseholders this information. Are they allowed to show the leaseholders* information about my mental health and history when it is not them taking me to court but the council. As I said they are providing the evidence against me. I would like to add that it was after a legitimate complaint from me about their plans to do a double loft conversion( contrary to their lease agreement) that they made the bird feeding complaint.The legitimate complaint has now turned in to a bird feeding issue and im most likely going to get a injunction* against me. This is about greed money and revenge. The statements also make allegations of ASB and they are trying to criminalise me in ASBO order to get me evicted. Will the judge want to know this? or will he just want to know I have fed the pigeons and caused a nuisance . They have 213 photos of my feeding the pigeons!! I want to deny the alleged nuisance but the evidence looks damming. some of the photos were "staged" (grid full of feathers and poo) and its going to be very hard to prove this.

Hello they have been after me for a year since I made the complaint about the illegal 24/7 Living room built 16ft from my vulnerable council tenants window.It was not dealt with so I wrote to Leader of Council and complained about the person responsible for dealing with it. He then came to my home and saw pigeons on roof and within half hour sent Resident officers for cpn and asbo at my door wanting me to admit to feeding pigeons on roof. I said no comment. Then sent EHO visits finds no problem but says not to feed pigeons. Then person responsible phones the EHO and asks if she has issued me with a CPN and she says no because she doesnt think there is health and safety issue but will monitor my bird feeding. Person responsible wants revenge and he is not happy with this so then instructs Lead Officer for Anti Social behaviour to visit. Constant visits and harassment until court case which I have had adjourned . The two witnesses for council are the two upstairs leaseholders who responsible for illegal outbuild and proposed illegal loft conversion. They were happy to make allegations of bird feeding and nuisance as I stopped the loft conversions, but shockingly council gave retrospective freeholders consent for the 24/7 Living room despite leaseholder who lied on planning permission by saying he owned the land. So giving away public purse money and allowing a build 16ft from a council tenants bedroom window at the expense of the tenant who will not complain. Judge wont want to know that the reason I am before a court is because of revenge greed and money. A legitimate complaint turned in to bird feeding issue To date cant get legal aid solicitor but got court to adjourn on medical grounds.I will get the injuction then if I break it could go to prison for feeding pigeons. This happened just recently. A pensioner got 6 weeks but served only three for feeding pigeons/seagulls on promenade.He came out fed them again and apparantly is back inside.So they will serve a injunction which stated cant feed or store feed within 5000meters radius of my home and have to have inspections and searches to prove im not stroring the feed. The person resposible will then beable to harass me whenever he wants and I cant refuse them access. All because I made a legitimate complaint about a illegal outbuild which now sets a precendent in that the council have allowed the Leaseholder to break the conditions of his lease , has lied on his planning application yet been given freeholders consent for a build 16ft outside a council tenants bedroom window in a communal block.Its almost unbelievable you couldnt make it up. And I will get a injunction which will be on my tenancy as being a problem tenant and wont be able to move.ASB allegations were alleged by leaseholder again as revenge for stopping the loft conversions thus preventing them financial gain at our expense. This is what happens when council property is sold off to property developers. We are the two downstair council tenants who have had to suffer unbelievable over development of the property.

An ASBO is a civil court injunction and does not result in a criminal record unless you break it.
perhaps you can negotiate so that you still feed the pigeons but on a reduced level so that the alleged nuisance is abated eg only give reduced feed in the morning and not at weekends.
it won't do you any good to keep on complaining about the developments that have taken place and how this is all a revenge attack upon you.
It might be true, but it won't help you.
