  • Car insurance claim for cost of lost extended warranty due to write-off

Hi all, just looking for some advice. A third party insurer, who's client has admitted full liability for the accident, is refusing to pay the £515 I paid for an extended warranty on my vehicle, which they have now written off. The extended warranty covered the two years immediately following the date of the accident, so I've now lost the benefit of that warranty. The insurance company states that since it was my personal choice to increase the warranty by an additional 2 years when I first purchased the car that they are not liable for it. It seemed reasonable to me to claim for the £515 as a lost benefit due to loss of the car. I'd welcome any thoughts on this and whether it is worth pursuing through e.g. the small claims court or some other means? Many thanks.

I do not understand the insurers reasoning.
If you had chosen to have your car gold plated and it was damaged by their insured, they would be liable for the damage to your car as it was at the time of the loss, not as it was before you chose to have it plated.
IMO you have lost the cover attached to the vehicle and are entitled to be indemnified**
Certainly go back and ask for a sensible explanation, or your money or you will initiate a claim against their insured for the shortfall.
