If the grant of probate states that someone died intestate, when there was a will, and if the person who applied for the grant was in fact the executor of the will, and they would share the estate under the will, but get everything if there was no will, have they committed a crime?
Is this probate fraud.

what is your concern? the fact a crime might have been committed or the fact that beneficiaries might not receive the gifts to which they are entitled?
Do you have the will?..Can you show the executor is aware of the existence of the will?
If a will is submitted after grant of letters of administration a judge can revoke the original grant and order an application for a new grant.
