    Hi,*
    I received the following parking ticket from this company today 30th Jan 2020. We were in a retail park on New Years Eve, spent time at Next (have receipts), then Costa Upstairs with the children.* * * * * * * * This is the first communication we have received from them no letter was received on or arounf the 10th Jan 2020 otherwise we would have responded and now they are saying as we failed to respond in 14 days the penalty is £85.00 please can you help and kindly guide me. Thank you.

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

    They will refuse the appeal but give you a POPLA code. Appealing to POPLA with all the other fails should be successful

    Send first class with free certificate of posting from any post office

    Do not hint at the identity of the driver

    Even if they did send a notice on the 10th January, a Friday, then it is assumed delivered 2 working days later which takes it to Tuesday 14th Jan, no way delivered in 14 days
