  • Smart Parking PCN

    Can someone please help me on this. I have received this PCN from smart Parking as the registered keeper. The driver went to a dessert shop there & thought it was free to park there. They called the the dessert parlour manager who informed them that it is a private company who runs the car park & that he had been done himself too. They also checked that the price is actually 50p for an hour parking & if the driver had known then obviously would of paid as they spent nearly £50 on desserts! Can anyone give me any advice on this PLEASE

    First edit your posts so that the identity of the driver cannot be inferred, use "the driver......."* etc.

    Then:

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. *You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

    First class post with free certificate of posting from any post office*



    Smart usually cancel but if they don't there are enough POFA fails to make a POPLA appeal go your way
