  • Issues with an audi a7 bought from a garage on HP finance

    Hi everybody first post on here, ive recently purchased a used audi a7 13 plate from a garage on hire purchase. The car waa bought on rhe 4th of january, i ran into the first few issues on the drive home with my partner, the car was advertised as having a satnav however the sd card or whatever it is wasnt in the packaging that they game me, we called and they said theyll send us one which to date we havent recieved, the next issue was flat tyres on the drive home As we drove from birmingham to manchester to collect the car on the way back we had noticed the tyre inflation warning on the dash, we filled it up thought nothing of it, gor home however the next day the tyre was flat again. Long story short the side wall of the tyre was in terrible condition, we had a kwik fit diagostic on the car and it came back saying the tyres ages was 6 and a half years old, also kwik fit told me the rear break pads were badly worn. I called the garage and told them.that i just had to spend 540 on 2 tyres and he was certain i shouldnt have paid that much, also i then noticed the headlight bulb was out. A few days after this i had a gearbox malfunction warning come up on my dash, i have since told the finance company and the garage that i am refusing the vehicle as i believe it was falsly advertised and its not fit fot purpose. The finance company are sending out an inspector to come and check the car however i dont believe the check is going to be very thorough as hes coming out to inspect it at my house. There is so much more to this story if anybody is interested in giving me some advice. Thanks

    The Inspector should be an appropriately qualified Motor engineer, in which case he should understand your concerns.* Might be worth checking if Kwik Fit are of the opinion that the tyre they replaced was potentially unsafe to add weight to your case.* If the Inspector is not appropriately qualified then he can only clarify the facts with you, he is not allowed to give any technical opinion on the state of the car. * Sounds like you're right on the whole, but if the garage or finance company are willing to get the issues dealt with, you may have to grin and bear it for a while to give them the chance to put things right, the car industry seems to get away with murder on that front.* Whether or not you'd then have a claim on the cost of tyres (and to what amount) depends on whether you bought similar quality to the originals, and allowing for the originals being second hand in any case.

      As you purchased the vehicle within the last 30 days the dealer/finance house do not have the option to repair the vehicle if you do not request or agree to that course of action.

      However it is for you to prove the vehicle was unsatisfactory at point of delivery.

        Thanks for the replies... quick update: the report from the inspector has gone back to the finance company, and the have found faults with the gearbox which the inspector has somehow claimed that they were not present during purchase of the car which i dont believe at all, since i bought the car ive only done around 250 miles in it (100 on the day of purchase driving it home) also i took the car to Audi to get a free health check on monday and they reported the rear break disks required immediate attention, however the next day on tuesday when the inspector came out, he seems to know better then Audi and has reported back to the finance company that the breal disks are fine... he done a visual check with help from the flashlight on his phone...? Pretty sure i believe Audi.

            Ok you now need to obtain a report from an independent qualified engineer.
            Suggest someone like DEKRA (https://www.dekra-expert.co.uk/vehic...gineers.report)

            And even if the gearbox problems were not present when the vehicle was delivered it is still unsatisfactory in that it has failed to be sufficiently durable

              Just looked at Dekra and their reviews arent the best! So with the gearbox fault do i have to give them a chance to repair the car or can i just refuse it and get a refund, because i believe the finance people are going to try to get me to let the garage who sold me the car who i dont trust one bit to try and fix it. However i dont want anything to do with the car now.

                As you are rejecting within the first 30 days you do not have to accept a repair.
                Your rights are contained in the Consumer Rights Act 2015 (http://www.legislation.gov.uk/ukpga/...ntents/enacted)
                read Chapter 2..... sections 19 to 24 in particular need your attention

                  Thanks again, im calling the finance company tomorrow as they should have reviewed the inspection by then, in regards to rejecting the vehicle, from what ive read i have to give them a chance to repair it? Or is this not the case as its within the 30 day period?

                    As it is within the first thirty days post delivery they do not have the right to insist on a repair

                      Hi again, the finance company and garage seem to be dragging their feet, fimance company have failed to get in touch with the garage with the inspection results, i am due to pay the first finance payment on the 5th of next month however i am totally against paying it. I told the finance people of i can block the payments with the bank and they said not to as it will most likely effect my credit score. Do i block payments or not? And how can i speed the process up because its stressing me out now. Thanks for any replies.

                        Do NOT block payments... it won't speed them up and only puts you in breach.
                        Send them a letter before action, and if they don't respond within the 14 days initiate a court claim

                            Update, the garage have accepted the return of the vehicle, however i have some unresolved issues, 1. I have recently sorned the car and theyre asking me to make a 2 hour trip to their garage to get the refund* 2. I had 2 brand new tyres fitted before the issues arised, costing £520 should i ask them for money or shall i try and put the old tyres back on? Also i part exchanged my old car and they still have it, will i get this back or will they just give me the money?

                              The dealer has to collect the vehicle
                              The refund must be made in the same way that payment was made, so if you used a card repayment is to the card.
                              I doubt you handed over five pound notes so don't see why you should need to travel.
                              You are entitled to your vehicle back unless it has been disposed of, in which case you are entitled to its moneys worth (ie part exchange value)
                              This is all covered in CRA 2015* Sec 20

                              Regarding the tyres you can try and negotiate a contribution towards their cost.
                              If you were to put the old tyres back on, what would you do with new ones? As second hand you will be lucky if you manage to sell them for anything near their true value.
