  • McDonald’s over stay

Hi as others I’ve received a letter from MET parking services with photographic evidence of entry and departure times. 51 minutes overstayed. The driver was there to meet a colleague and discuss training materials. The driver and colleague both bought coffees twice and meals. No receipts available and it’s miles out of my way to go and talk to the manager.
The “offence” took place on the 18th December I received the letter today. 16th January.

Advice on wether the £50 should be paid or not

First advice is to edit so that the identity of the driver cannot be inferred, use "the driver......." etc.

    Your response is:

    Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

    Yours etc

MET usually cancel but if you have to appeal to POPLA then you probably will be successful.

If they reject your appeal then post up a redacted copy of the PCN so that the other fails can be pointed out

There frequently a hidden condition whereby if you ask the manager then you can get an extension.
